The dismissal of a Blackwater BHP miner who'd worked for the company for nearly 40 years because of inappropriate comments made to two female cleaners has been found to have been justified but procedurally unfair by the Fair Work Commission.

According to BHP's letter of termination, the male miner in question had made comments to two female cleaners
